Larkins v. Capistrano Unified School District
Hylton & Associates Partner Courtney Hylton and Associate Brendan Gardiner obtained a complete defense verdict, where the jury deliberated for less than one hour following a five-week trial.
Hylton & Associates represented a school district and its special education teacher in a personal injury case venued in Orange County.
Plaintiff, a special education student, alleged negligent supervision during a touch football game caused a TBI, fractured collar bone, and aggravated his preexisting scoliosis, which ultimately resulted in spinal surgery. In closing, Plaintiff’s counsel asked the jury for an award of $8 million, including $3,153,011 for future medical specials; $1,800,000 for past pain and suffering; and $3,011,250 for future pain and suffering.
Defendants maintained the school activity was properly modified for the participants and appropriately supervised. Defendants also disputed the nature, cause, and extent of Plaintiff’s claimed injuries and damages.
